Why in News ?

Department of Consumer Affairs under Ministry of Consumer Affairs, Food & Public Distribution has received various representation for exempting the garment or hosiery sold in loose or open at the point of sale from the Legal Metrology (Packaged Commodities) Rules 2011.

    garment or hosiery industry selling garment or hosiery items in loose or open.

    • Common/ generic name of the commodity
    • Net qty. in std. unit of W or M or no. of commodity in the package
    • Unit sale price
    • Month and year of manufacture or pre-packing or import
    • Best before or use by date, month and year in case of commodity becoming unfit for human consumption with time
    • Consumer Care name & address
  • To protect the interest of consumers, 4 declarations relevant to the consumers only to be given.
  • Following information relevant to consumers is to be given :
    • Name and address of the manufacturer/ marketer/ brand owner/ importer with country of origin or manufacture in case of imported products.
    • Consumer care email id and phone number.
    • Sizes with internationally recognizable size indicators such as S, M, L, XL, XXL and XXXL along with details in metric notation in terms of cm or m.
    • Maximum retail price (MRP).

The rule regulate pre-packaged commodities in India and inter – alia mandate certain labeling requirements prior to sale of such commodities.

What is Legal Metrology (Packaged Commodities) Rules?

  • An Act to establish and enforce standards of weights and measures, regulate trade and commerce in weights, measures and other goods which are sold or distributed by weight, measure or number and for matters connected therewith or incidental thereto.
  • Declarations to be made on every package : Every package shall bear thereon or on label securely affixed thereto, a definite, plain and conspicuous declaration made in accordance with the provisions.
  • In the case of a package having a capacity of ten cubic centimetre or less the principal display panel may be a card or tape affixed firmly to the package and shall bear the required information.
  • Subject to the provisions of rule 6 every package kept offered or exposed for sale or sold shall bear conspicuously on it
    • The name and complete address of the manufacturer, or where the manufacturer is not the packer, the name and address of the manufacturer and the packer and in case of imported packages, the name and address of the importer.
  • An export package shall not be sold in India unless the manufacturer or packer has re-packed or relabelled the commodity in accordance with the provisions.
