Why in News ?

The Supreme Court gave High Courts two months to repair inadequacies and inefficiencies in the criminal trial system of their respective States.

Key Facts

  • Supreme Court had in April 2020 given States and their High Courts six months to incorporate the recommendations in their police manuals and criminal trial processes.
  • Guidelines are referred to as Draft Rules of Criminal Practice, 2020.

Draft Rules of Criminal Practice, 2020

  1. Related to investigation
    • Printed format of the human body with sketch must indicate if there are any injuries for postmartem and Medico Legal Certificate.
    • Custodial deaths : Police photographer or state nominated photographer or any independent private photographer should be arranged by the investigation officer. 
    • During trial police should submit the videos and photographs through a panchnama. Besides site plan with details and attach it to the spot panchnama.

    • Hard copy of the signed recorded testimony will be with the Presiding Officer and should be made available free of cost to the accused or an advocate representing the accused, the witness and the prosecutor.
  3. In case of conviction, the judgment must separately indicate the offence involved and the sentence awarded.
  4. Exhibit number must show the witness number of such witness to make it easy to locate them.
  5. Use the ranks to refer to the accused based on the charges and not their names except at the stage of identification by the witnesses.
  6. Conviction and Acquittal
    • Judgment must separately indicate the offence involved and the sentence awarded.
    • During acquittalCourt can give directions to release the accused if accused is not in custody in any other case.
