Why in News ?

Union Home Ministry has served a show-cause notice to former chief secretary of West Bengal Alapan Bandyopadhyay under a stringent provision of the Disaster Management Act.

  • It entails imprisonment up to two years.
Key Facts
  • The notice was issued for failing to comply with the Centre’s directions to attend the review meeting on Cyclone Yaas chaired by the Prime Minister in Bengal’s Kalaikunda.
  • The Act is violative of Section 51 (b) of the DM Act, 2005.
  • About Section 51 (b)
    • Whosoever refuses to comply with any direction given by or on behalf of the central government or the state government or the National Executive Committee or the State Executive Committee or the District Authority under this Act, shall on conviction be punishable with imprisonment for a term which may extend to one year or with fine, or with both.
DM Act 2005:
  • Ministry of Home Affairs as the nodal ministry for steering the overall national disaster management.
  • The Act also devotes several sections to various civil and criminal liabilities resulting from violation of provisions of the Act.
  • It puts into place a systematic structure of institutions at the national, state and district levels.
National Disaster Management Authority (NDMA)
  • To build a safer and disaster resilient India by a  technology driven and sustainable development strategy.
  • Prime Minister of India, is the apex body for Disaster Management in India.Disaster Management Act Section
  • Setting up of NDMA and the creation of an enabling environment for institutional mechanisms at the State and District levels is mandated by the Disaster Management Act, 2005.
  • NDMA is mandated to lay down the policies, plans and guidelines for Disaster Management.
  • NDMA has 5 major divisions viz.
    • Policy & Plans
    • Mitigation
    • Operations & Communications
    • Information & Technology
    • Administration and Finance.
